How can we avoid the incorrect treatment of our personal data?
By implementing the legislation established in the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27th April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”) and in the Organic Law 3/2018 of December 5th on Protection of Personal Data and Guarantee of Digital Rights (known in Spanish as “LOPD”).
Which steps do we need to take to adapt a company to the current regulations?

What is a personal datum?
All the information of a particular person, identified or identifiable, for example: name, e-mail, fingerprint, DNI, etc.
What are the rights of the data subject?
GDPR allows the data subject to exercise the rights of access, to rectification, to erasure (right to be forgotten), to restrict processing and to object and automated decisions (including profiling).
When is it necessary to appoint a processor of personal data?
GDPR requires the appointment of a processor of personal data for the companies in the following cases:
- Where there is regular and systematic monitoring of data subjects on a large scale (e.g. shopping malls).
- When handling special category personal data relating to criminal convictions or offences.
LOPD regulates other specific cases.
Which obligations must be complied in the installation video surveillance?
Video surveillance should only be used when it is not possible to use any other less invasive means. In any case, it is necessary
- Display a sign clearly indicating the Data controller
- Subscribe the corresponding contract with the processor of personal data (when necessary)
- Draw up a register of activities
- Retain the images for a maximum period of 30 days, unless requested from the pertinent authorities.
